Terms of Use

These terms govern your use of www.magemen.com and, unless a signed statement of work says otherwise, the way we start talking about a project. Paid work is scoped in writing. If a statement of work, proposal, or retainer agreement conflicts with this page, the signed document wins for that engagement.

1. Who we are

Magemen is a senior ecommerce development agency established in 2010. We build high-growth B2B and DTC commerce on Adobe Commerce (Magento), Shopify and Shopify Plus, BigCommerce, and WooCommerce, and we ship ERP, PIM, 3PL, and custom API integrations. Delivery runs follow-the-sun from Little Rock, Auckland, and Lahore.

2. The website

Content on this site — platform pages, case metrics, certifications, and sample work — is for information. It is not a bid, a licence, or a promise that we will take every project. We may refuse or refer work that is a poor fit.

You may not scrape the site in a way that degrades it, copy the design system or copy as if it were your agency’s, or imply Magemen built or endorses a store we did not.

3. Assessments and enquiries

The “Start a Project” form and the 15-minute assessment are no obligation. We aim to reply within one business day with a real plan, timeline, and number. Figures mentioned on the site (audits from $5k, builds typically $25–100k+) are orientation, not a quote. A quote exists only when we send it in writing for your catalog, integrations, and constraints.

You agree the brief you submit is yours to share, and that you will not send production secrets, cardholder data, or other people’s personal data in that public form.

4. Services

When we are engaged, work may include some or all of:

• Ecommerce web design and development
• Replatforming and migration (catalog, customers, orders, redirect maps, SEO equity)
• Performance, Core Web Vitals, and CRO
• B2B and wholesale (company accounts, quotes, contract pricing)
• Headless commerce (Hydrogen, Catalyst, GraphQL storefronts)
• Health-check audits and consultancy
• Apps and integrations (NetSuite, SAP, Dynamics, custom APIs, marketplace apps)
• Ongoing retainers after launch

Engagement models on the site are fixed-scope sprints for builds and replatforms, and monthly retainers for growth. Weekly demos and a shared backlog apply either way, unless the statement of work says otherwise.

5. Client responsibilities

You will:

• Provide timely access to the platforms, ERPs, and stakeholders the work needs
• Own the licences for Adobe Commerce, Shopify Plus, BigCommerce, WooCommerce, NetSuite, and any other vendor product we implement
• Make product, legal, and brand decisions we cannot make for you (tax, privacy copy on your store, claims about your goods)
• Keep staging and production credentials rotated and scoped

6. Third-party platforms

Adobe, Shopify, BigCommerce, WooCommerce, NetSuite, SAP, Microsoft Dynamics, hosting, and CDNs are not Magemen products. Their uptime, pricing, API limits, and policy changes are outside our control. We build against them as they stand when we scope. A platform breaking change after go-live is handled under a retainer or a new change request, not as an open-ended warranty.

7. Intellectual property

You keep your brands, catalogs, and content. We keep our pre-existing tools, internal playbooks, and unreleased accelerators. Custom work we create for you under a paid statement of work is assigned to you when invoices for that work are paid, except for third-party open source, vendor code, and any Magemen or third-party app listed on a public marketplace — those stay under their own licences.

Case studies and metrics on this site may describe live client builds. We do not disclose confidential client data in those write-ups. You may not republish our case copy as your own.

8. Results and metrics

We instrument revenue, conversion rate, and Core Web Vitals when that is in scope. Figures on the site (for example LCP, conversion lift, or GMV on a visual) are examples from work we have done or illustrative UI. They are not a guarantee that your store will hit the same numbers. Ecommerce outcomes depend on catalog, traffic, merchandising, and operations we do not control.

9. Confidentiality

Both sides will keep non-public project information confidential and use it only to do the work, except for information that is already public, independently developed, or required by law. Our Privacy Policy describes how enquiry and personal data is handled.

10. Payment

Fees, schedule, and expenses are in the statement of work or retainer. Late or missing payment can pause delivery. We do not start production cutovers (replatforms, ERP go-lives) while invoices that are due remain unpaid, because freeze windows and rollback plans need a solvent, staffed team.

11. Warranties and liability

We perform services with the care of senior ecommerce engineers. We do not warrant that a store will be error-free, that a marketplace will accept an app, or that search rankings will hold after a migration — we preserve SEO equity with redirect maps and testing; Google still decides.

To the fullest extent allowed by law, Magemen is not liable for lost profits, lost GMV, or indirect damages. Our aggregate liability for an engagement is limited to the fees you paid us for that engagement in the three months before the claim, unless the signed statement of work sets a different cap.

12. Termination

Either party may stop a sprint or retainer as the statement of work allows. You remain responsible for work already performed and for non-cancellable third-party costs we committed at your instruction. We will hand over repositories and credentials we hold for you once accounts are settled.

13. Changes to these terms

We may update this page for the website. For an active paid engagement, changes to commercial terms happen in writing, not by a silent website edit.
